Welcome to www.ekcc.nabard.org ("Website") owned and operated by 24x7 Money Works Private Limited ('eKisanCredit'), a company incorporated under the provisions of the Companies Act, 2013 and having its registered office at 205-206, Corner Point Jetalpur Road, Vadodara- 390 007 India.This document/agreement/understanding is a computer-generated electronic record published under the provision of Rule 3 of the Information Technology (Intermediaries Guidelines) Rules, 2011 read with Information Technology Act, 2000 and does not require any physical or digital signatures.This Agreement sets forth the terms and conditions that apply to the access and use of the Website "www.ekcc.nabard.org" and its Mobile Application, before you may use the Web/App, you must read all of these General Terms of Use ("Terms") herein and the Privacy Policy provided on the Website. These terms apply to the eKisanCredit's products, software, services and website or App owned and operated by 'eKisanCredit'.By using eKisanCredit's products, software, services and website or App ("Services") you agree to be bound by these terms and conditions (Terms and Conditions). You also acknowledge that we have provided you with our Privacy Policy. We have the right to update/modify/alter these Terms and Conditions from time to time. You should regularly review this page to familiarise yourself with our updated/modified/altered Terms and Conditions. If you do not agree to be bound by these Terms and the Privacy Policy, you may not use the Services in any manner.PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. YOUR ACCEPTANCE OF TERMS CONTAINED HEREIN CONSTITUTES THE AGREEMENT BETWEEN YOU AND eKISANCREDIT FOR THE PURPOSE AS DEFINED HEREUNDER.
  1. eKisanCredit reserves the right at any time, at its sole discretion, to change or otherwise modify the Terms without prior notice, and your continued access or use of Services signifies your assent/ratification of the updated or modified Terms. If you object to these Terms or any subsequent modifications, alteration or substitution to these Terms in any way, your only recourse is to immediately terminate use of the Services. We may require you to agree to additional terms (if any) between you and eKisanCredit in connection with specific services that you may avail from time to time. The service provided by eKisanCredit through Website/App is available and appropriate only for use in India.

  2. PROPRIETARY RIGHTS

    You acknowledge and agree that:

    1. eKisanCredit owns all rights, title and interest in and to the Services, including any intellectual property rights which subsist in the Services.
    2. You do not have the right to use any of eKisanCredit's trade names, trademarks, service marks, logos, domain names, and other distinctive brand features.
    3. You do not have the right to obscure, remove, or alter any proprietary rights notices (including trademark and copyright notices), which may be affixed to or contained within the Services. You will not copy or transmit any of the Services.

  3. Eligibility

    The Service is not available to minors under the age of 18 or to any users suspended or removed from the system by eKisanCredit for any reason. Users may not have more than one nontransferable active account. If you disqualify or debar for any reason whatsoever, you may not use the Services. You are responsible for maintaining the secrecy of your password, login and account information. You will be responsible for all use of the Website/App by you and/or anyone using your password and login credentials (with or without your permission).

  4. LICENCE & WEBSITE ACCESS

    1. eKisanCredit grants you limited licence to access and make use of Services for personal and non-commercial purpose.
    2. You agree to provide true, accurate, current and complete information about yourself as and when prompted by the Website. If you provide any information that is untrue, inaccurate, not updated or incomplete or becomes untrue, inaccurate, not updated or incomplete eKisanCredit shall have the right to suspend or terminate your account and/or refuse any and all current or future use of the Services in connection thereto.
    3. By making use of the Services, and furnishing your personal/contact details, you hereby agree that you are interested in availing and purchasing the Services that you have selected. You hereby agree that eKisanCredit may contact you either electronically or through phone, to understand your interest in the selected products and Services and to fulfil your demand or complete your application.
    4. You explicitly understand and agree that by using the Services you authorize eKisanCredit and its affiliates and partners to contact you for any follow up calls in relation to the Services you intended to avail. You agree and consent to receive communications on your phone/mobile number provided by you on the Website and expressly waive any registration made under DND/NCPR list under TRAI regulations.
    5. You shall not sell eKisanCredit's Services or employ any robot, spider, virus, malware, other automatic device, or manual process to monitor or copy the Website and or its content or interfere or disrupt the Website.

  5. Usage of Mobile Application

    Subject to these Terms and Conditions, we grant you a non-transferable, non-exclusive, royaltyfree, license to install one copy of the App, solely on your handheld mobile device and solely for your personal use for the purpose of receiving our Services. We own and remain, at all times, the owner of the App. You must not otherwise copy, transmit, distribute, reproduce (for compensation or otherwise), licence, alter, adapt, reverse engineer or modify the whole or any part of the App in any way. You acknowledge that rights in the App are not sold to you, and that you have no rights in, or to, the App or the technology used or supported by the App other than the right to use each of them in accordance with these Terms and Conditions.

  6. Our Services

    1. The Services have been designed to align with our beliefs and values that:
      1. You're unique and you should get best deal on agriculture loans.
      2. You're a valuable customer - we want you to have access to our innovative tool that you can use to give Financial Service Provider a better idea about just how valuable you might be.
    2. We've set up a bidding marketplace enabling you to apply for a new agriculture loan products or the ones you already have by introducing you to our panel of selected financial services providers/partners ("Partners").
    3. Your customer profile will be provided to the Partners in order for them to submit an indicative best Bid response to your Bid Request which will be based on the information you have provided and the product you have requested in your Bid Request (Bid Response).
    4. The Bid Response will set out some of the details of the product the Partner is offering (for example, the applicable interest rate). We do not guarantee that any Provider will submit a Bid Response upon receiving your Bid Request and customer profile.
    5. The Products that are the subject of the Bid Reponses are supplied by the Partners. If you wish to accept a Bid Response, you may indicate your intention to enter into the relevant arrangement with the Partner who submitted that Bid Response. However, the Bid Response will not be legally binding on you or the Partner until you have and the Partner have entered into formal documentation on its usual terms.
    6. Partner's bid Response will be subject to their normal deposit/ lending policies and procedures, including responsible deposit/lending practices and verifying your identity and any details you have submitted.
    7. It is important that you understand that once you decide to accept a Bid Response by a Partner, you will be dealing directly with that Partner and not with us. Get an independent advice about the bid-responses if you need to. eKisanCredit doesn't make any representation about the suitability of any products or service "bid responses" for which you may receive using this website or App.
    8. We are not the supplier of any products that you may view or select through the website/app and we are not responsible for the content of any Bid Response. The website/app is designed to facilitate your transaction with the relevant Partner.

  7. PRIVACY POLICY

    You confirm that you have read, understood and accepted our Privacy Policy.

  8. OUR PARTNERS

    Display of loan or other financial products, offered by third parties, on the Website/App does not in any way imply, suggest, or constitute any sponsorship, recommendation, opinion, advice or approval of eKisanCredit in favour/against such third parties or their products. You agree that eKisanCredit is in no way responsible for the accuracy, timeliness or completeness of information it may obtain from these third parties

    Your interaction with any third party accessed through the Website is at your own risk, and eKisanCredit will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence of any such third parties or for any personal injuries, death, property damage, or other damages or expenses resulting from your interactions with the third parties.

    You agree and acknowledge that the credit shall be at the sole discretion of eKisanCredit's financial partners (Financial Institutions, Banks, Non Banking Financial Companies and Credit Rating Agencies) while making any application through the Website for a financial product offered by such financial partners; eKisanCredit shall not be held liable for any delay, rejection or approval of any application made through its Website.

  9. KNOW YOUR CUSTOMER COMPLIANCE POLICY

    You agree and acknowledge that for undertaking any financial transaction through the website, Our Company may undertake user's due diligence measurers and seek mandatory information required for KYC purpose which as a user you are obliged to give, while facilitating your request of loan/credit requirements with our financial partners, in accordance with the applicable PMLA laws and rules. We may obtain sufficient information to establish, to its satisfaction or the financial partners, the identity of each new customer, and the purpose of the intended nature of relationship between you and the partners. You agree and acknowledge that we can undertake enhanced due diligence measures (including any documentation), to satisfy itself relating to customer due diligence requirements in line with the requirements and obligations under the applicable PMLA Act and rules.

  10. COLLECTION AND USE OF INFORMATION

    By sharing or submitting any content including any data and information on the Website, you agree that you shall be solely responsible for all content you post on the Website and eKisanCredit shall not be responsible for any content or information you make available on or through the Website. At eKisanCredit's sole discretion, such content or information may be included in the Service and ancillary services (in whole or in part or in a modified form). With respect to such content or information you submit or make available on the Website, you grant eKisanCredit a perpetual, irrevocable, non-terminable, worldwide, royalty-free and non-exclusive license to use, copy, distribute, publicly display, modify, create derivative works, and sublicense such materials or any part of such content. You agree that you are fully responsible for the content or information you submit.

    The security of your information is very important for us. We take reasonable steps to protect your privacy, and at our end, we regularly review developments in security and encryption technologies.   12. DISCLAIMER OF WARRANTY

    The Website and all content and Services provided on the Website are provided on an "as is" and "as available" basis. eKisanCredit expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and security and accuracy, as well as all warranties arising by usage of trade, course of dealing, or course of performance. eKisanCredit makes no warranty, and expressly disclaims any obligation, that: (a) the content will be up-to-date, complete, comprehensive, accurate or applicable to your circumstances; (b) The Website will meet your requirements or will be available on an uninterrupted, timely, secure, or error-free basis; (c) the results that may be obtained from the use of the Website or any Services offered through the Website will be accurate or reliable; or (d) the quality of any products, services, information, or other material obtained by you through the Website will meet your expectations.

  13. LIMITATION OF LIABILITY

    eKisanCredit (including its officers, directors, employees, representatives, affiliates, and providers) will not be responsible or liable for (a) any injury, death, loss, claim, act of god, accident, delay, or any direct, special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including without limitation lost profits or lost savings), whether based in contract, tort, strict liability or otherwise, that arise out of or is in any way connected with (i) any failure or delay (including without limitation the use of or inability to use any component of the Website), or (ii) any use of the Website or content, or (iii) the performance or non-performance by us or any provider, even if we have been advised of the possibility of damages to such parties or any other party, or (b) any damages to or viruses that may infect your computer equipment or other property as the result of your access to the Website or your downloading of any content from the Website.   15. WAIVER

    Any failure or delay by eKisanCredit to enforce or exercise any provision of these Terms, or any related right, shall not constitute a waiver by eKisanCredit of that provision or right. The exercise of one or more of eKisanCredit's rights hereunder shall not be a waiver of, or preclude the exercise of, any rights or remedies available to eKisanCredit under these Terms or in law or at equity. Any waiver of any provision shall only be effective if made in writing and executed by a duly authorized officer of eKisanCredit.

  16. FORCE MAJEURE

    If performance of Services/Website by eKisanCredit is prevented, restricted, delayed or interfered with by reason of labour disputes, strikes, acts of God, floods, lightning, severe weather, shortages of materials, rationing, inducement of any virus, malware, trojan or other disruptive mechanisms, any event of hacking or illegal usage of the Website, utility or communication failures, earthquakes, war, revolution, acts of terrorism, civil commotion, acts of public enemies, blockade, embargo or any law, order, proclamation, regulation, ordinance, demand or requirement having legal effect of ible for the content or information you submit.any government or any judicial authority or representative of any such government, or any other act whatsoever, whether similar or dissimilar to those referred to in this clause, which are beyond the reasonable control of eKisanCredit and could not have been prevented by reasonable precautions, then eKisanCredit shall be excused and discharged from such performance to the extent of and during the period of such force majeure event, and such non-performance shall, in no manner whosoever, amount to a breach by eKisanCredit of its obligations herein or incur any legal liability on eKisanCredit.

  17. ADDITIONAL TERMS

    You may not assign or otherwise transfer your rights or obligations under these Terms. eKisanCredit may assign its rights and duties under these Terms without any such assignment being considered a change to the Terms and without any notice to you. If we fail to act on your breach or anyone else's breach on any occasion, we are not waiving our right to act with respect to future or similar breaches. Other terms and conditions may apply to loans or other financial products that you may apply on the Website. You will observe these other terms and conditions. The laws of the India, without regard to its conflict of laws rules, will govern these Terms, as well as your and our observance of the same. If you take any legal action relating to your use of the Website or these Terms, you agree to file such action only in the courts located in Vadodara, Gujarat, India. In any such action that we may initiate, the prevailing party will be entitled to recover all legal expenses incurred in connection with the legal action, including but not limited to costs, both taxable and non-taxable, and reasonable attorney fees. You acknowledge that you have read and have understood these Terms, and that these Terms have the same force and effect as a signed agreement. This paragraph shall survive termination of this agreement.
